 MINUTES OF THE

 HIGHLAND OAKS HOMEOWNERS ASSOCIATION

A regular meeting of the full association membership of the above association was called to order on July 22, 1997 at  7:08 p.m. by president Steve Hammel. It was held in the original model home at the corner of Inverness and Highland Oaks Drive, New Albany, Indiana.

The purpose of this meeting  was to discuss issues with the developer, Greg Furnish, regarding the status of Crossman Communities in  Highland Oaks.

1.     CROSSMAN COMMUNITIES.  Greg Furnish announced that as of this date TriMark has only purchased two lots in Highland Oaks and is in violation of their original contract. He stated that he has sent them notice that he has broken their contract on the grounds of “failure to perform”. The existing TriMark homes (the intended model home and the 2-story on Inverness Drive) will be completed and sold. He is still considering who to work with to market Highland Oaks again but is most likely to return to Schuler.

2.     FUTURE POSSIBILITIES. Greg stated that he has the sewer credits for Phase II and is seeking bids on the excavation with Cristiani. If it appears that Phase II can be in place in time he plans to submit a request to have Highland Oaks be considered as a site for the 1998 Indiana Home Expo.

3.   OTHER DISCUSSION.

Greg was requested to provide the members of the Homeowners Association with a copy of an official letter detailing what has and will transpire with Crossman Communities.

Jeff Doire made a motion that the Association vote to raise the minimum square footage of homes in Highland Oaks to 1525 and make basements mandatory. It was decided to delay this until the next meeting when an official vote would be taken on the matter.

Residents agreed to take down their ‘For Sale By Owner’ signs for a few days to give Greg a chance to negotiate the final details of the contract with Crossman.

Someone suggested pulling out the windows of the TriMark trailer and converting it into a hot dog stand during a possible ‘Open House’ weekend.

4.  NEXT MEETING.  The next meeting of the  Association was tentatively scheduled for July 29, 1997. The meeting adjourned at 8:00pm.
