 MINUTES OF THE

 Full Association Membership

 OF

 HIGHLAND OAKS HOMEOWNERS ASSOCIATION

 A regular meeting of the full association membership of the above association was called to order on July 8, 1997 at  7:09 p.m. by president Steve Hammel. It was held in the original model home at the corner of Inverness and Highland Oaks Drive, New Albany, Indiana.

 The purpose of this meeting  was to discuss issues with the developer, Greg Furnish, regarding the future direction of Highland Oaks.

 1.  DUES.   Treasurer Jeff Johnson reported that most residents have paid their Association dues and he is following up with the few that haven’t paid yet.

 2.  FRONT ENTRANCE.   Greg Furnish reported that he is looking for ideas on how to better landscape the front entry. He is thinking of using large river gravel behind the stone walls. He continues to get bids for placing wrought iron in the walls but the bids have all been coming back high in his opinion. He asked if anyone knew of any other sources to let him know. Several plants seem to be dying around the entrance and better drainage is apparently needed. He has also been in contact with Indiana Gas about placing gas lamps in the center island.

 3.  CROSSMAN COMMUNITIES.  The major topic of discussion at this meeting was on the future of Highland Oaks and what part Crossman Communities would play. Greg stated that he was within days of making a final decision on what the future direction will be.

4.   Other Items Discussed.

Steve Hammel made an appeal to Greg Furnish asking what the current residents could do to help him break his contract with Crossman. Steve reported that the reason why a meeting never materialized between the officers, Greg, and Blaine Ballard was that when Steve called Blaine to set up the meeting Blaine stated that he would be willing to discuss the park, the neighborhood in general, or anything else except “why my houses suck”. Steve took this as clear evidence that a meeting would do no good.

TriMark (Crossman) has apparently signed 2 contracts for houses in Highland Oaks.

Greg stated that his primary concern was ensuring that the minimal sale price of all houses in Highland Oaks was at a certain level.

Residents are concerned about the appearance of  the unsold lots. Greg stated that he will take care of the mowing or perhaps need to subcontract it.

Greg was asked if legally he could let other builders back in or if it was purely his decision. The contract with Crossman currently gives them exclusive building rights. However, he also stated that within a couple of weeks they must buy and start a certain number of houses or else their contract would be violated.

Jim Hitchcock displayed a leaflet that was apparently distributed in a low income housing area by Crossman. It stated that the minimal annual income requirement to purchase a home in Highland Oaks from TriMark is $37,000. Several residents were extremely upset by this action as they moved into Highland Oaks in order to hopefully get away from various problems normally associated with lower income areas. Jim asked Greg directly why he had signed the initial contract with TriMark when Highland Oaks was already off to such a good start. After much back and forth discussion Greg admitted that in the end the decision was all financial.

Steve announced to Greg that he has a letter describing the events of the previous year drafted and ready to send to the Indiana Homebuilders Association, the attorney general, and anyone else he thinks may be able to help with the situation if things are not resolved soon.

The restriction amendments voted on at the last meeting have not been filed yet. Greg stated that he needs a copy of the minutes from that meeting in order to do so.

 5.  NEXT MEETING.  The next meeting of the  Association was tentatively scheduled for July 22, 1997. 

 The meeting adjourned at 8:33pm.
